                                  LICENSING

         "For until the law sin was in the world: but sin is not
          imputed when there is no law."  Romans 5:13

As used above, the word "imputed" is from the Greek `ellogeo'.  It means
to reckon or to put on account.  In the text it reflects exactly what
you would expect from a just God.  He does not hold a person accountable
who is innocently ignorant of His law.  So, you have just passed the
point of no return.  Even if you stop reading right here, you will only
remain ignorant.  Willfully ignorant, not innocently. If you read on,
you will no longer be ignorant but will become convicted and convinced,
and that's good.  We all want to be free but we can't be until we find
out what the truth is.  (John 8:32)

This essay is going to talk about one of the most common and pervasive
evils in America today.  It is all the more evil because it is accepted
as the norm.  The subject is licensing.  From this day forward when you
see or hear the word "license" you should recoil as though you had just
stumbled onto a rattlesnake.  Licensing is almost always tied with evil.
The good and proper applications for a license can be counted on the
fingers of one hand.  They are rare.

We will begin with the word itself.

                                 LICENSE

	"A  formal permission to  do  something."  Webster's College
	Edition.  "The permission  by competent authority  to do  an
	act which,  without such  permission,  would  be  illegal, a
	trespass, or a tort."  Black's Law Dictionary, 5th Ed.

The word "license" is from the Latin `licentia', from which we also get
the word "licentious", meaning that which is morally unrestrained.  In a
general sense, a license purports to allow that which is forbidden.
There are a few instances where this is proper.  For example, years ago
my grandfather owned a large farm in the midwest.  It was discovered
that some of his unused land had large amounts of gravel in it that was
suitable for road building.  My grandfather therefore licensed, or
allowed, the state to come in and dig out the gravel; for a price of
course.  So, what would have otherwise been a trespass and theft was
made permissible by a license.  And my grandfather was the only one who
was competent to grant the license because it was his gravel and his
land.  His right to absolute and unmolested ownership of his property is
a right that he received from God.  A right that is described in God's
word and that is protected by American law when that law is enforced.
By way of contrast, there are many in America today that believe that
there is no such thing as an absolute individual right like the right to
own property.  They believe that if the state's (mob's) need is somehow
greater or more important than an individual's, then it is all right for
the state to violate an individual's rights.  This is wrong for two very
important reasons.  First, God's law has said that we must not steal,
defraud, murder or in any way violate the God-given rights of another
person.  It matters not if it is one violator we are talking about or
10,000 violators using the power of the state to do the deed.  Either
way it is still wrong.  Secondly, once that you admit or acquiesce to
the idea that the majority (state) is superior to the minority
(individual), then you have laid the foundation stone that is the basis
of all tyranny and no individual will ever be secure again.  Even worse,
you have set the state up as a god by making it superior to the
individual.  This is a crucial point that must be recognized.  ANY
GOVERNMENT THAT PLACES ITSELF ABOVE THE INDIVIDUAL AND HIS RIGHTS IS A
TYRANNY!  There are no exceptions, only varying degrees of tyranny.
This was not the intention of those who wrote and adopted our federal
Constitution.  They very deliberately included a Bill of Rights as a
clear warning to government that individual rights were not to be
violated for any reason.


	"The  conventions  of a number of  the  states having at the
	time of their adopting the Constitution, expressed a desire,
	in order to prevent  misconstruction or abuse of its powers,
	that further  declaratory and  restrictive clauses should be
	added:"
                      Preamble to Bill of Rights.

Government in America was created a servant, not a sovereign.  God is
the sovereign.

What does all this talk of rights have to do with licensing?  Simply
this; 99.99% of all licenses issued in America are issued BY government
TO individuals.  That is, issued by the servant to the master.  This can
mean only two things: that the people have become servants or subjects
of the government and/or that the people are asking government for
permission to violate God's laws.  An illustration will help.  Everyone
has heard of a marriage license.  A marriage license is literally the
grant of permission from government to get married.  QUESTION: since God
created the institution of marriage, why do people ask the state for
permission to get married?  God also created the institution of baptism
but we don't ask the state for a baptism license.  This is more than
just a minor formality.  A state licensed marriage is a STATE CREATED
marriage.  And what the state creates it can tax, regulate or destroy.
Additionally, the state is sovereign over the substance of the marriage,
including the children.  That is why in a divorce proceeding, the state
decides who gets the house, car and children.  Incidentally, divorce is
a perfect example of asking the state for permission to do what God has
forbidden (Matthew 5:31,32).  In the eyes of the state, parents are only
trustees over the children.  The state owns them because they are part
of the proceeds of a state-created civil marriage.  If you don't think
this is so, just ask a Probate Judge.

Another example of state licensed activity is the corporate license.
One of the main reasons that people incorporate is to receive the state
granted privilege of limited liability.  The privilege granted is the
ability to get deep into debt and then not repay what you owe.
Individuals as well as corporations frequently seek this privilege when
they petition the bankruptcy court to protect them from their creditors.
Because of this privilege, and because of greed, ignorance and other
factors, DEBT has become a way of life in America.  The governments,
state and federal, are all deeply in debt; nearly all the people are in
debt, even our "monetary" system is based on debt.  This shouldn't be.
It is one thing to ask God to forgive us our debts against Him.  It is
entirely different to ask the state to excuse us from our debts to
others, and thereby violate the rights of our creditors.  In fact, this
is a perfect example of one individual using the power of the state to
violate the rights of another.  God's law doesn't allow this and the
state has no authority to license a violation of God's law.  In a sense,
licensing is the Devil's counterfeit to God's grace.  When we submit to
the authority of God, He gives us His grace so that we are justified
apart from the law.  (Romans 4:14-16)  By contrast, a license first
requires that you submit to the authority of the state, after which the
state purports to license exemption from God's laws.

Hopefully, you can now see the contrast between God-given rights and
state licensed privileges.  They are nearly always in conflict with each
other.  It is related to the warning the Lord gave us when he said that
we cannot serve two masters.  A modern adaptation of that warning is:

           WHENEVER YOU ACCEPT A LICENSE, YOU GIVE UP A RIGHT! 

The Bill of Rights referred to earlier are rights granted by God to man
according to His law which defines the attendant responsibilities.  For
example; Article    VI of   the Bill of  Rights   begins:

	"In all criminal  prosecutions, the accused  shall enjoy the
	right to  a speedy  and public trial,   by an impartial jury
	..."

Many state constitutions also contain wording similar to this, further
establishing the right.  If you have ever been in a traffic court you
will know that what juries they allow are usually at the discretion of
the magistrate, are only half juries of six, and their decision can be
overruled by the magistrate.  They are in reality only "window dressing"
to give the appearance of justice.  And yet, most traffic violations are
tried as "crimes" under criminal rules of procedure.  Specifically, they
are "crimes against the state".  Sound familiar?  That's how criminal
prosecutions are referred to in communist countries.  Has the state
violated our Constitutional right to a jury trial, i.e. to be judged by
our peers?  NO!  You give up that right when you accept a driver's
license!  We have given up the protection of a jury trial, one of the
rights that men died to protect 200 years ago.  The great protection of
the jury trial was the fact that no matter what sort of legislation came
out of government, no matter what the state declared to be a "crime", no
citizen could ever be punished by the government for anything unless a
jury of 12 of his fellow citizens believe him to be guilty of
wrongdoing.  And it didn't require a written statute.  Any act that the
Grand Jury considered criminal could be tried.  Today, thousands of
citizens are fined or jailed by the state in all kinds of different non-
constitutional "courts".  Traffic court, Probate court, Tax court and
Hunting/Fishing violations are all examples of the various regulatory
jurisdictions that have been erected to judge and punish the licensed
individual.

Here are some more examples of Rights replaced by licenses.  Do you
attend an incorporated church that has accepted the tax-exempt privilege
from the state?  If so, then don't think that you are exercising your
First Amendment right to freedom of religion.  Corporations do NOT
have Constitutional rights.  Have you asked the state for a license to
carry or own a firearm?  If so, then you have given up your Second
Amendment right to keep and bear arms.  Have you incorporated your
business?  If so, you have given up your Fourth Amendment right to be
free from unreasonable or warrantless searches.  The state or the IRS
can march in and go through your papers or building whenever they
choose.  By very definition, a right is a sacred gift from God.  The
moment that the state is allowed to restrict, regulate or condition that
right, at that moment it ceases to be a right and becomes a state
controlled privilege.

Feeling a little oppressed now?  If not, this essay on licensing has
failed to awaken in you a hunger for the magnificent liberties that we
once enjoyed in this country.  Some people cannot even imagine the
unlimited freedom that once existed here.  They believe that such total
freedom would bring about the collapse of the country.  Given the
generally irresponsible attitude of most people today, they are probably
correct.  The blessings of freedom will not return until we shoulder the
responsibility of governing ourselves.

It comes down to this.  If we want to enjoy God's blessings of life,
liberty and happiness, then we must be willing to assume responsibility
for ourselves by obeying and enforcing His laws.  This has nothing to do
with picking candidates for public office.  When the people are jealous
and knowledgable of their rights and God's laws, it matters little who
is in office.  Some of the most tyrannical kings of history have been
kept in check by oftimes illiterate peasants who were jealous of their
liberties.  There are three basic requirements: 1.  A general knowledge
of the truth.  2.  A pure jury system.  3.  An armed citizenry.  History
shows that they are generally implemented in that order, too.  Knowledge
of the truth to prevent injustice; a pure jury system to correct
injustice; and armed citizens to end injustice.  On the other hand, if
you want to escape your responsibilities, receive licentious privileges
from the state, and cling to the false promise of cradle-to-grave
security, then, by all means make Caesar your God.

	SERVITUDE BETTER THAN THE  ANIMATING CONTEST OF  FREEDOM, GO
	HOME FROM US IN  PEACE.  WE ASK  NOT  YOUR COUNSELS OR ARMS.
	CROUCH  DOWN AND LICK  THE HANDS WHICH  FEED YOU.   MAY YOUR
	CHAINS SET LIGHTLY UPON YOU, AND  MAY  POSTERITY FORGET THAT
	YE WERE OUR COUNTRYMEN.

                             WHAT YOU CAN DO

The first thing to do about licensing problems is to determine what
areas of your life are affected.  Nearly every married couple will have
a marriage license and most adults have a driver's license.  (NOTE: if
you fly airplanes, you do NOT have a Pilot's "license".  There is no
such thing.  You might have a Pilot Certificate.)  Whatever the license,
it is almost certain that you did not get it without asking for it.
Therefore, to undo the situation, you must cancel or void that request.
In most cases this is accomplished by making up an affidavit stating
your intent and filing it with the appropriate branch of government.
Don't forget to return the license, too!  The affidavit should be
recorded as a matter of public record.

A sample might look like this:

                 AFFIDAVIT RESCINDING ___________ LICENSE
        I,_________, by and through this affidavit, do hereby rescind my
        signature on ________License number________ and on the original
        application therefore.
        The basis for this rescission includes, but is not limited to,
        Fraud, Duress, Coercion, Mistake of Fact and other invalidating
        circumstances.
        Further, it is Affiant's firm belief and conviction that the above
        described license is neither necessary nor proper and that the
        Affiant's right to (marry, drive, fish, hunt, etc.) is not an
        activity that should be governed or regulated as a State created
        privilege.

Be sure to sign the affidavit in the presence of a Notary and make
provision for the Notary's seal and signature.  Other language may be
included as necessary to completely define your intent.  Most lawyers
will be of no help in composing an affidavit because they will not be
able to comprehend why you are doing this.  A good office supply store
will carry blank general affidavit forms that can be modified to suit.

The above will cover most situations regarding individuals.  In the case
of a corporate license, the laws of your state must be examined to
determine the proper fashion for dissolving a corporation.

DON'T BOTHER TO DO ANY OF THE ABOVE IF YOU DON'T INTEND TO EXERCISE AND
DEFEND YOUR NEWLY DISCOVERED RIGHTS!  That would indeed be a hollow
gesture.  This is NOT something that you do to establish yourself as a
"Militant" or "Freedom Fighter".  It is done as an individual effort
aimed at reestablishing our country's law system according to our
Biblical, Common Law heritage.  It won't happen from the top down.  It
will happen when individuals turn from their present ways and return to
the standards that made America great in the first place.

It is likely that many people will not understand the rationale behind
rescinding a license.  That says something about how we have been
conditioned to think.  In any case, the biggest contribution that
individuals can make is to educate themselves about the truth and then
to teach others.  For an illustration, though, let's look at the
driver's license situation as an example of the problem and the
solution.

One of the proper functions of any state government is the regulation of
matters involving public safety.  Nearly all roads and highways in a
state are built by the government with our tax monies.  It is proper,
then, for the state to provide the citizens with safe roads.  Speed
limits are supposed to reflect the maximum SAFE speeds for a road as
determined by the engineers who designed it.  Among other things, this
tells the person driving emergency vehicles, such as fire trucks and
ambulances, how fast that they can safely travel.  Vehicle equipment is
also a proper concern of government since unsafe vehicles are a danger
to the public.  The final consideration is the vehicle operator himself.
The state's responsibility here is to insure that each operator has the
necessary skills and knowledge to drive safely.  In a word:
CERTIFICATION.  In the field of aviation it has been done this way from
the beginning and has given aviation an admirable safety record.  Pilots
are certified ONCE for each category and type of aircraft that they
wish to operate.  After that, they are only required to have regular
medical exams and periodic proficiency reviews.  The pilot certificate
itself never expires and serves only as evidence, a diploma of sorts,
that the holder has the certified level of skill and knowledge.  By
comparison, we need only look at the highway traffic death toll to see
that possession of a driver's license is no indication of skill or
knowledge in the holder.  About 99.9% of all vehicle accidents involve
licensed drivers.  Practically speaking, driver's licenses today perform
two functions: 1.  Identification, and 2.  they bring the driver under
the jurisdiction of the traffic "court."  Along with identification,
they also provide "Big Brother" with current personal information about
the individual, including a picture.  The Traffic Court's primary
purpose is revenue.  If, as advertised, the court's function was to
correct or remove dangerous drivers, we wouldn't have the accident
statistics that we do.  Evidence of the court's function as a revenue
source is found in the large number of victimless "crimes" prosecuted by
the state against individuals.  For example, if you are driving at 70
mph on an interstate (all of which are engineered SAFE for 70+ mph) you
can be charged with the "crime" of speeding, prosecuted and fined
heavily.  But where is the victim?  What threat have you posed by
operating at the designed safe speed limit?

What it all boils down to is this: no matter what we have been told
about licensing purposes, the reality is that it is primarily a means
for the state to monitor, regulate and tax/fine the citizens that it is
supposed to be protecting.  Similar examples could be given about
business licensing, occupational licensing and marriage licensing.  No
doubt there are many more.

One problem that is related to marriage licensing and that is currently
on the rise is the intervention of the state directly into the family.
The news media is reporting with increasing frequency on incidents where
officers from some state agency have marched into a home or school to
kidnap a child because there was an "allegation" of misconduct on the
part of the parent.  Misconduct, in this realm, can be nothing more than
giving a child a spanking. In some cases the "misconduct" is the act of
teaching your child at home instead of leaving him in the public schools
until he is brain-dead.  (The declining quality of public education is
no secret.  Over the last ten years or so numerous articles and books,
radio and television programs have been produced on the increasing
number of illiterate high school graduates coming out of the public
school system.)  Whatever the circumstance, the giant question that is
not being raised is WHERE DID THE STATE GET THE AUTHORITY TO INVADE THE
HOME?  If a crime has really been committed there are proper proceedures
for obtaining warrants and protecting people and property.  That is NOT
what is happening, however.  A mere innuendo on the part of a
disgruntled neighbor is all that's required for the state to forcibly
remove children from a home.  Without a hearing, trial or any form of
due process of law.  This should frighten us.  Most folks seem to think
it normal.  Do we wait for it to happen to ourselves before we do
something?
